ClientEarth commissioned Surya Advisory to examine if technical clauses used as risk shifting mechanisms in Power Purchase Agreements create obstacles for the transition to sustainable energy systems in Asia. The identification and redrafting of these clauses are important for reaching the goals of the Paris Agreement and the Sustainable Development Agenda 2015.

We identify market provisions found in model power purchase contracts. The report provides drafting assistance and recommendations to civil society organisations for shifting the risk to fossil fuel companies.

We provide contractual best practice for use by government, civil society and climate and human rights advocates during strategy building, dialogue and negotiations. Our study will inform stakeholders within other Global South jurisdictions many of which face similar energy sector challenges.
